Terms and Conditions

  1. SCOPE
    For all orders of goods offered in our online shop the following conditions apply.

  2. GENERAL CONDITIONS
    These General Terms and Conditions determine the relations between the parties to the purchase agreement, where on the one side is Haworthialand.com, František Veselý, Zahradní 365, 267 24 Hostomice, Czech Republic, ID number 04903200 (hereinafter referred to as “The Seller”) and on the other side is the buyer (hereinafter referred to as “The Buyer”).

  3. CONTRACT
    The order is created when The Buyer puts the selected goods in the cart and confirm and sends the order. Before The Buyer confirms the order in a binding manner, he can change both the required goods in the basket and the method of transport and method of payment. The Buyer is obliged to check all the data he provided / selected when creating the order. The purchase contract is concluded by confirming the order created by The Buyer by The Seller, The Seller is not responsible for any errors in data transmission. The Seller will immediately confirm the conclusion of the contract to The Buyer for information by e-mail to the e-mail entered by The Buyer.

  4. ORDERING AND CANCELATION
    Minimal order is 20 EUR. Please use only the e-shop for ordering, because when order is placed the stock of all the ordered plants is automatically decreased, which helps a lot to be more effective. The stock in e-shop shows availability of good at the moment, however, it can happen that two or more customers order the same plant with limited stock and even that they were available at the moment of ordering, they can be already gone; this can happen mainly when new offer is released and more growers search for new plants.
    The Buyer have the right to cancel the Order at any time prior to the shipment of the goods without any penalties.

  5. DELIVERY AND DELIVERY TIME
    Order is prepared after payment is made. The plants/seeds are dispatched within a week after payment, when a new offer is issued it can take longer. You will be noticed when your order is sent and obtain tracking number. All the plants are sent without pots and substrate. Delivery to outside of the European Union is on your own risk, for lost parcels no replacement will be done.

  6. POSTAGE FEES
    Prices are shown in cart when shipping country is set on checkout or after log in.
    1. Registered airmail (Czech postal service) – standard international postage;
      pricing: EUROPE – 11 EUR, REST OF THE WORLD – 15 EUR
    2. GLS – reliable delivery service for EU countries, mainly faster than Czech postal service (recommended especially for Italy); highly recommended for Belgium, Netherlands, Italy, Spain – delivered within 5 working days! For these countries is delivering through Czech postal service rather slow now (sometimes 3 weeks); the prices ranges between 17-43 EUR, depeds on country; for sending via GLS phone number is mandatory so please do not forget to fill it in when checkout;
    1. EMS – Express Mail Service;
      Canada, USA 45 EUR;
      China, Japan, Taiwan, Thailand – 50 EUR
    2. If you want to place additional order to be sent with your previous order you can do, then please choose in options postage as “Free – please choose only if placing additional order to be sent with previous order”
    3. Seeds (when available) are sent by registered airmail – 6 EUR; you can choose either small box (mostly fit to 15x9x3.5 cm) or bubble envelope.
    4. Within the Czech Republic the plants and seeds are sent by Czech postal service
      – plants: 129 CZK (“do ruky”), resp. 109 CZK (“na poštu”), seeds: 59 CZK

  7. PHYTOSANITARY CERTIFICATE, FEES WHEN SENDING OUTSIDE EU
    If you need a phytosanitary certificate, please buy it in the e-shop in menu under “Phytosanitary” link. The price of the certificate is 35 EUR. All the plants sent outside EU require additional cleaning from soil – it is charged 3 % of value of the plants (as “Handling fee” on checkout). Please let me know about import regulations and requests of your country.

    Check carefully if there are import conditions to your country for the goods you ordered and inform us exactly. Shipments that are destroyed or returned by customs due to their missing information or documents cannot be refunded. Some countries (Canada, South Africa, Namibia, New Caledonia etc.) require an import permit, which you must apply for. Please let me know about import regulations and requests of your country.

    Up to 12 plants can be sent directly to USA to your address with just phytosanitary certificate. For shipments with more than 12 plants we need your import permit. The import permit requires delivery to the Plant Inspection Service USDA APHIS. The place of fulfilment for shipments to USA with import permit is exclusively your Plant Inspection Station. If you do not pick up your goods at the Plant Inspection Station you send us the fully paid and correctly completed label to destination of a carrier of your choice, which we will gladly put in the box for you. The label is used for shipping from the Plant Inspection Station to your delivery address.

  8. PLANT PASSPORTS FOR SENDING TO EU COUNTRIES
    There is no need of phytosanitary certificate for the EU countries but all the shipments with plants sold via internet has to be attached with plant passports (free of charge).

  9. PAYMENT OPTIONS
    Payment is made right away after the shopping process and agreenment with terms of sale offered. We must receive payment of the whole of the price for the goods before an order can be accepted. Once we have received payment from you, we will confirm that your order has been accepted by forwarding an e-mail to you at the e-mail address given with the order. Acceptance of your order will bring into existence of an officially binding Contract between us.
    Payment methods:
    PayPal – fee 4 % for EU countries and 5.5 % for non-EU countries
    Stripe – payment gateway which allows accept payments directly onsite; fee 2.9 %
    Bank Account – transfer directly to my bank account are welcome; you can use this option also when you do not want to pay right away (because something needs to be consulted for example); if you use this option, please pay within 7 days; free of charge (sometimes there can be an intermediate bank fee 10-15€ – usually from payment outside of Europe, so please ask your bank to pay all fees)

  10. COMPLAINTS, REFUND AND RETURN POLICY
    If the plants you received came damaged, died during the transport or there is any other problem, please let me know as soon as you receive them or latest 14 days you received the plants; later no complaints will be accepted. I would like to always try to solve a problem to your satisfaction. Return of plants is not possible as they would be for too long in parcel which would cause etiolation and further damage. Seeds and other goods can be returned to my address. In that case they will be refunded. Refunds or partial refunds are sent back via way the money were accepted.

  11. SIZE AND CONDITION OF THE PLANTS
    Size of the plants is 2-3 cm if not stated otherwise, age of the plants is mostly 2-5 years.
    Most of the Haworthias are seedlings, so every plant is original (please note that some are really variable), Adromischuses are grown from leaves, so you mostly get the same clone as in the picture, but sometimes more clones is available. It may be separated in e-shop, each clone with own picture and own number – for example 00713.2 – where 00713 is ID number for this plant in my database and the number after dot “2” means it is clone nr. 2. Sometimes this numbering is also used for Haworthia seedlings when there are two different growth forms – for example in case of H. arachnoidea var. nigricans ‘venteri’ there are seedlings with smooth leaf margin and also with margin with teeth – so these are sometimes separated. After ID number there can be also size differentiation. So for example 00882.L would mean “large” plants, “S” small, “M” medium…
    Pictures in the e-shop are only illustrative (if not stated otherwise) – the main purpose is to show how certain plants look in features and colors when well grown, not to show the plants which are for sale at the moment (I am sorry I cannot take everytime new picture), size of the plants for sale is noted with each item in the e-shop (or it is 2-3 cm in diameter otherwise).
    Most of the plants are grown in pure pumice, some in mixture of coconut substrate, sand and pearlite.
    Please take into account when the plants are delivered they were some days in darkness so they need some time to get used to normal light again – so please do not place them on direct sun!
    Although I will do my best when packing the plants, please take into account that especially some Adromischus forms are very fragile and leaves detach easily.

  12. GERMINATION OF SEEDS
    I cannot guarantee all the seeds will germinate 100 %, they are harvested during whole year in different conditions. In case some would not germinate (although in my experience most of Haworthia seeds germinate quite well) then I can refund money for such seeds if they were sown within a few months after purchase (of course if almost nothing germinate then there was other reason than bad seeds). Haworthia seeds are well viable for at least two years if well stored (not wet and not hot). I store them in a not heated room where temperatures are around 15° C. In such temperatures they are still viable even after 3 years.
